Billy Baxter Reminiscing About His Landmark Court Case
Level 10: 800-1,600, 200 ante
Late in the last level, Jonathan Little and Eric Hershler are listening intently as Billy Baxter tells some of the background behind his landmark court case, William E. Baxter Jr. v. United States (1986).
Baxter sued the U.S. government, claiming that the money he won in poker was earned income and not gambling winnings. This had implications not only for the tax rate (the difference that year would have cost Baxter $178,000), but it would determine whether or not poker earnings could be used to fund retirement accounts.
The Nevada court ruled in Baxter's favor, but the U.S. government appealed to the Ninth Circuit Court of Appeals -- and Baxter won again. The government threatened to take the case to the U.S. Supreme Court, but the case never went that far.
Baxter wasn't boring Little and Hershler with these boring details, but much more interesting behind-the-scenes stories, including something about an FBI wiretap.
